On Viral Mandaluyong Hit-and-Run Incident – Finally Justice Will Take Its Course After Driver Surrenders to Police Authorities

NCRPO- Finally, justice will take its course after the driver behind the SUV involved in the trending hit and run video of a security guard in Mandaluyong City personally appeared along with his parents and lawyer, Atty. Danilo Macalino before the police authorities in Camp Crame, Quezon City on June 15, 2022, following the warning of the OIC, CPNP PLTGen VICENTE D DANAO JR of serious consequences if he will not surrender.

The suspect was identified as one Jose Antonio Sanvicente, driver and owner of the vehicle who hit Floralde – the security guard who was directing traffic at the intersection of Julia Vargas Avenue and St. Francis Street in Mandaluyong City.

“We (the PNP) are glad that he finally surrendered to face the consequences of his actions and shed light to the circumstances behind the event. We already have a solid case here as the suspect himself confirmed and admitted before the Filipino people that he was indeed the driver when the mishap happened. The public can expect that we will assist the victim in seeking justice for the injuries he sustained as a result of that tragic incident.

With this, NCRPO would like to send a message to everyone that your police enforces the law without fear and favor and justice does not take sides regardless of who they are.” Said PMGEN Naividad.

Passed the allowable time to arrest him under warrantless arrest, police officers were not able to hold and/or put him under restraint when he appeared and surrendered on June 15, 2022.

Noteworthy to mention that unlawful arrest or arrest without warrant will make all pieces of evidence obtained inadmissable in court and will lead to the dismissal of the complaint, to which we cannot allow to happen.

Nonetheless, complaints for frustrated murder and abandonment of one’s own victim were filed against him before the Mandaluyong City Prosecutor’s Office through regular filing.

Likewise, a preliminary investigation on the incident is set on June 17. As soon as an arrest warrant be issued against him from the judicial court, the PNP is ready to comply with the court’s ruling and will not waste time to implement it.

Coordination has also been undertaken with the owner of the dashcam video and uploader and he manifested his willingness to stand and testify as a witness.

“We, in the law enforcement are performing our mandated task fair and just. We shall continue to render assistance in as much as we are lawfully authorized to ensure that justice prevails. He will surely have his day in court. Hindi magtatagal ay mananagot siya sa batas at kakaharapin ang mga consequences ng kanyang ginawa sa ating kababayan ,” RD Natividad, added.

Consequently, an immigration lookout bulletin order was issued by the DOJ against Sanvicente to monitor if he would attempt to leave the country. ###
